Statutory Expungement - Minnesota Statute 609A
​
Prior to 2015, even if a judge sealed your record, in most cases it was still available at the BCA and could be searched online. The new law changed that by dramatically expanding the circumstances in which a criminal conviction or record of arrest could be completely sealed. Statutory expungement is available under the following circumstances:

First time drug possession cases that received a statutory stay of adjudication under Minnesota Statute 152.18.

Offenses committed by juveniles who were prosecuted as adults.

If the charges were dismissed or you were acquitted.

If you successfully went through a diversion program, or received a stay of adjudication, and have not committed any crimes for a year.

If you were convicted, or received a stayed sentence, for a petty misdemeanor or misdemeanor charge, and you have not been convicted of an offense for two years since you were discharged from probation.

If you were convicted, or received a stayed sentence for a gross misdemeanor, and have not completed any crimes for four years since discharged from probation.

Selected Felonies- Minnesota Statute 609A.02 Subd. 3(5).

If you have been convicted of one of the listed felonies, and have not been convicted of a crime for five years since discharged from probation.
Additionally, the law still allows expungement under a court’s “inherent authority.” In these cases, only the records at the courthouse are sealed, but in some cases this limited option may be a good choice.
