Minnesota Marijuana Attorney

Possession of drug paraphernalia is a petty misdemeanor and punishable by up to a $300 fine. A second conviction is a misdemeanor and punishable by up to 90 days in jail and/or a $1,000 fine. Minnesota Statute 152.092

​

Minnesota law defines a “small amount” of marijuana as 42.5 grams or less. Possession of a small amount of marijuana, or a sale without “remuneration” (payment of some sort) is a petty misdemeanor. A second offense within two years is a misdemeanor. 

​

Possession of any amount of marijuana wax, concentrate, or edibles is a felony level offense.

Marijuana in a Motor Vehicle - Minnesota Statute 152.027

​

The owner or driver of a motor vehicle found to have 1.5 grams of marijuana on them, or in an area easily accessed by the driver or passenger, is guilty of marijuana in a motor vehicle, a misdemeanor offense. This law does not apply to the trunk of a vehicle.

Fifth Degree Controlled Substance - Minnesota Statute 152.025

​

  • Possession of more than 42.5 ounces of marijuana;

  • Sale of marijuana for cash;

  • Any amount of marijuana wax, edibles or concentrate;

  • The penalty for possession or sale of a controlled substance in the fifth degree is five years prison and/or a $10,000 fine.

Fourth Degree Controlled Substance - Minnesota Statute 152.024

​

Selling marijuana in in a school zone, public housing zone, or drug treatment facility. Fourth degree possession or sale is punishable by up to 15 years and/or a $100,000 fine.

Third Degree Controlled Substance - Minnesota Statute 152.023

​

  • Possession of 10 kilograms or more;

  • Sale of 5 or more kilograms;

  • Third degree sale or possession is punishable by up to 20 years in prison and/or a $250,000 fine.

Second Degree Controlled Substance - Minnesota Statute 152.022

​

  • Possession of 25 kilograms or 100 plants;

  • Sale of 10 kilograms;

  • Selling 5 kilograms of marijuana, in a school zone, park, public housing zone or drug treatment facility;

  • Second degree possession or sale of a controlled substance is punishable by up to 25 years in prison and/or a $500,000 fine. A second degree conviction with one or more priors is subject to a three year mandatory minimum prison sentence.

First Degree Controlled Substance - Minnesota Statute 152.021

​

  • 50 kilograms of marijuana or 500 plants

  • Sale of 25 kilograms or more
